The GamiMarket acts as a passive conduit for the online distribution and publication of User Content and has no obligation to screen communications or information in advance and is not responsible for screening or monitoring User Content posted by Users. However, the GamiMarket may review and delete any User Content that, in its sole judgment of, violates these Terms of Use, violates applicable law, rule or regulation, is offensive or illegal or violates the rights of, harms or threatens the safety of Users of GamiMarket. We reserve the right to expel Users and prevent their further access to the GamiMarket for violating the Terms of Use or applicable law, rule or regulation and the right to remove User Content which is in violation of the Terms of Use, abusive, illegal, or disruptive.
Obligations Of Users

The users who have signed up as sellers expressly state that the information provided regarding their app or any data being fed into the network of GamiMarket by the them is correct and complete in all respects and does not contain any false, distorted, manipulated, fraudulent or misleading facts or averments. GamiMarket expressly disclaims any liability arising out of the said information/ data so fed into the network of GamiMarket by the user. GamiMarket assists the seller on the platform to sell their full source code of the app to the buyer. Further, the user agrees to indemnify GamiMarket for all losses incurred by GamiMarket due to any false, distorted, manipulated, defamatory, libelous, vulgar, obscene, fraudulent or misleading facts or otherwise objectionable averments made by the user on the network of GamiMarket
The User is solely responsible for maintaining confidentiality of the User password and user identification and all activities and transmission performed by the User through his user identification and shall be solely responsible for carrying out any online or off-line transaction involving credit cards / debit cards or such other forms of instruments or documents for making such transactions and GamiMarket assumes no responsibility or liability for their improper use of information relating to such usage of credit cards / debit cards used by the subscriber online / off-line.

The sellers and buyers must only get in touch with eachother through GamiMarket, and must not bypass the GamiMarket communication mailbox; Users are not allowed to exchange and share their email id, phone no, skype id, Facebook id or any other communication contact on the network; and All kind of communications must happen on GamiMarket work stream. Payment
The payment policies for Users may change at any time.
Once a buyers BID matches the sellers ASK price for an application, it then becomes Sold and the total final price will be charged to the payment method entered by the user.
If the payment is not received to GamiMarket whether be from lack of funds, expired card, or any other reason within 24 hours, your account will be locked until the payment is processed and received by GamiMarket. No payment within 48 hours of the application being Sold, will result in the application being automatically be relisted onto the market for other buyers to bid.
GamiMarket’s Fee is 20% from each Sold application. The 20% will be charged from the Total Sold price once the payment has been processed.
An order executed in multiple transactions will be charged a separate commission for each transaction.
Additional taxes will be applicable to any users within Canada.
Suspension And Termination Of Account And Service
Generally, a User Account will be considered active until we receive a user request to deactivate or delete it. GamiMarket takes steps to verify the credentials and company status of its members. We do not guarantee that the Website or any content contained on the Website will always be available or be uninterrupted. We reserve the right to limit, suspend, terminate, modify, or delete the User Account we provide to you or your access to our Services or portions thereof (including any Content you or other users submit) for any reason, with or without notice and at any time, including, without limitation, if you are, or we suspect that you are, improperly using the Services, violating any applicable laws or failing to comply with this Terms of Service. We also reserve the right to stop offering and/or supporting the Services or any part of the Services at any time either permanently or temporarily, for any reason, with or without notice to you, at which point your use of the Services or any part thereof will be automatically terminated or suspended. Assignment

Subject to the foregoing restriction, these Terms will be fully binding upon, inure to the benefit of, and be enforceable by us and our respective successors and assigns.
Nonwaiver
Failure by either GamiMarket or You to exercise or enforce any right conferred shall not be deemed to be a waiver of any such right nor operate so as to bar that exercise or enforcement thereof or of any other right on any later occasion.
Indemnification You agree to defend, indemnify and hold harmless GamiMarket and its respective employees, contractors, officers, directors, shareholders, agents, representatives, vendors, and content providers from and against any and all liabilities, claims and expenses, including attorneys' fees, that arise from a breach of these Terms of Use for which you are responsible or in connection with your transmission of any content to, on or through our website. Force Majeure
GamiMarket shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control; including, without limitation, any failure to perform hereunder due to unforeseen circumstances or causes beyond its control such as acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor or materials.
Governing Law And Arbitration a. Governing Law. You agree that: (i) the Service shall be deemed solely based in Ontario; and (ii) the Service shall be deemed a passive one that does not give rise to personal jurisdiction over us, either specific or general, in jurisdictions other than Ontario. This Agreement shall be governed by the internal substantive laws of the province of Ontario, without respect to its conflict of laws principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. Though “No Refund” Policies are generally permitted, GamiMarket strongly recommends against this business practice because it often leads to high customer chargebacks.
